Why SDS Is Mandatory in Bulgaria (EU REACH/CLP Framework)
The legal basis for the SDS in Bulgaria is identical to all other EU member states, derived from the directly applicable EU Regulations:
REACH Regulation (EC) No 1907/2006: Article 31 mandates the provision of an SDS for all substances and mixtures classified as hazardous, defining the content requirements.
CLP Regulation (EC) No 1272/2008: This regulation governs the classification, labelling, and packaging of chemicals in the EU, and the SDS must be 100% consistent with its rules.
Commission Regulation (EU) 2020/878: This amends Annex II of REACH and sets the latest mandatory format and content requirements for all SDSs placed on the EU market, effective since January 2021 (with older formats permitted until December 2022).
National Authority: The Ministry of Environment and Water (MOEW) and the Regional Health Inspectorates enforce these EU regulations nationally.
A compliant SDS for Bulgaria must be:
Format: The mandatory 16-section SDS format defined by REACH Annex II, as updated by Regulation (EU) 2020/878.
Language Specific: The SDS must be supplied entirely in Bulgarian (Български език), the official language of Bulgaria, as mandated by the EU for the country where the product is placed on the market.
Content: For hazardous mixtures, it must include the Unique Formula Identifier (UFI) code in Section 1.1.
Key Differentiator: Poison Centre Notification (PCN)
While most EU Member States have fully transitioned to the centralized ECHA Submission Portal for Poison Centre Notification (PCN), Bulgaria is currently the only EU country that still requires PCN submissions exclusively through its national notification system.
This means that companies placing hazardous mixtures on the Bulgarian market must:
Generate the UFI code (if they are the formulator/importer).
Submit the required mixture data to the Bulgarian National Authority (likely via the Ministry of Health or relevant inspectorate) using the national process, which may differ from the ECHA harmonized format.
