Why SDS Is Mandatory in Ecuador
The legal requirement for the SDS is based on technical regulations, environmental mandates, and the country's membership in the Andean Community (CAN):
GHS Mandatory Implementation: The GHS is mandatory, enforced primarily through Technical Regulation NTE INEN 078:2013 and the national standard NTE INEN 2266:2013 ("Transport, Storage and Handling of Hazardous Materials. Requirements.").
GHS Version: This framework initially adopted the provisions of the UN GHS, 1st Revised Edition, though it is best practice to align with the latest accepted standard in the region (and the required standard for the SDS format is international). The official mandatory date was February 1, 2018.
SDS Format and Content: The SDS must adhere to the format specified in the standard NTE INEN-ISO 11014.
The SDS must strictly follow the standard 16-section structure (Hoja de Datos de Seguridad).
Mandatory Chemical Registration: Ministerial Agreement 099 (and the subsequent Reglamento al Código Orgánico del Ambiente - Decreto 752/2019) mandates the registration of hazardous chemical substances. Individuals involved in the import, export, manufacture, or storage of these substances must apply for the Certificate of Registration of Hazardous Chemical Substances with the National Environmental Authority (Ministerio del Ambiente, Agua y Transición Ecológica). The SDS is a mandatory document for this registration process, which is managed through the Sistema Único de Información Ambiental (SUIA).
Language Requirement: The SDS and the label must be entirely in Spanish (Español), the official language of Ecuador, for legal compliance and submission to authorities.
