GHS Implementation & National Chemical Registry (RENASQ) Services for Peru

By Zoesoe Exports Pvt Ltd – Your Trusted Partner for Peruvian & Andean Compliance

Peru has established a modern, mandatory chemical safety framework through Legislative Decree No. 1570 (Integral Management of Chemical Substances Law) and its forthcoming regulations. This system mandates the adoption of the Globally Harmonized System (GHS) and requires the mandatory registration of chemical substances in a new national inventory.

Why SDS Is Mandatory in Peru

The legal basis for the SDS is comprehensive, covering public health, environment, and worker safety:

  1. GHS Mandatory Implementation (Decree 1570): Legislative Decree No. 1570 mandates the use of the UN GHS for the classification, labeling, and SDS preparation of chemical substances and mixtures.

    • GHS Version: Peru has formally adopted the 6th Revised Edition of the GHS.

    • Competent Authorities: The Ministry of Health (MINSA) and the Ministry of Environment (MINAM) share responsibilities for GHS implementation and managing the national registry.

  2. Mandatory Registration (RENASQ): The Decree establishes the National Registry of Chemical Substances (RENASQ). Manufacturers and importers of hazardous chemicals must declare and update information in this registry. The GHS-compliant SDS is a mandatory document for this registration process, which is set to be implemented in phases starting in the coming years.

  3. SDS Format and Content: The SDS must be prepared in accordance with Annex 4 of the UN GHS (16-section format). It must be provided free of charge by the manufacturer/importer and must include the version number and date of issue.

  4. Language Requirement: Both the SDS and the label must be entirely in Spanish (Español), the official language of Peru, for legal compliance and submission to authorities.

A compliant SDS for Peru must be:

  • Format: The mandatory 16-section SDS format (based on GHS Annex 4).

  • Language Specific: Written entirely in Spanish.

  • GHS Version: Classified based on UN GHS, 6th Revised Edition, noting the exclusion of acute toxicity category 5.

  • Accessibility: Must be easily accessible at the point of use of the chemical.
